The majority of HOAs have rules regarding parking and vehicles on the property. While all rules differ, most HOAs in Santa Clarita have regulations on the types of vehicles permitted, how long a vehicle has been parked in the same spot, and where the vehicle is parked.

HOA Parking Laws for Your Car

HOA car laws typically allow an association to have authority over parking and vehicles on private roads within the development. Vehicles parked on public roads, however, can not generally be towed by the HOA, even if the road is within their development. Cars illegally parked on public streets are usually under the rule of the police. Nevertheless, there are a few exceptions and the HOA may have the authority to tow a vehicle on public roads if the vehicle is contained in governing documents. Some associations may be able to enforce regulations on work or recreational vehicles parked on public streets, for example. 

Notices for Violations

Although HOAs have the authority to tow a car that is improperly parked on their private property, they must give sufficient notice before doing so. HOA car laws state that an association must give a violation notice at least 96 hours before actually towing the vehicle. They must also gain authorization to tow and notify their local agency after being authorized.
